Donating a Car to Charity in MA

Donating a car is a way to support a charitable organization while still reaping an economic benefit through a tax deduction. All donors should be aware that tax deductions for used automobiles, boats or airplanes are available only to those individuals who donate to a qualified charity and who itemize deductions on their tax returns. Following are some tips to consider when deciding whether to donate your car to charity.

Do make sure that you are donating to an eligible organization. Tax deductions are available for donations made to §501(c)(3) organizations, public charities which the Internal Revenue Service has determined to be tax-exempt. To verify an organization's qualified status, contact the Public Charities Division at (617) 727-2200, ext. 2101; the IRS Tax Exempt/Government Entities Customer Service at 1-877-829-5500; or look for IRS Publication 78 in your local library's reference section or on the IRS website. Churches, synagogues, temples, mosques, and governments are not required to register with the Non-Profit Organizations/Public Charities Division or to apply to the IRS for tax-exempt determination. They may not be listed in Publication 78, but donations to these institutions are tax deductible.

Do ask the charity plenty of questions. Find out what the organization's mission is and how your donation will help it. Ask if your donation can go to a particular program or service that interests you or whether it must go only into the charity's general fund. Do not donate to an organization that avoids talking about its charitable purpose or refuses to send you information.

Do ask what the charity will do with your car. Some charities refurbish cars and give them to people in need. Some technical schools use cars in their auto shop programs. Other organizations simply resell the car or sell its parts and use the proceeds for their charitable purposes.

Do ask if the charity handles all aspects of your donation. Many charities contract with for-profit companies to handle all the details of motor vehicle donations. If this is the case, ask how the money from your car donation is split between your charity and the for-profit company.

Deduct only the amount allowed by law. Section 884 of the American Jobs Creation Act of 2004 added sections 170(f)(12) and 6720 to the Internal Revenue Code and changed the rules for donations of motor vehicles, boats, and airplanes beginning in 2005. There are different rules concerning deductions, depending on the value of the car and on whether the charity will keep and use the car or whether it will sell the car (or its parts). The IRS has published "A Donor's Guide to Vehicle Donations" (Publication 4303), which details the new rules. You can obtain Publication 4303 from the IRS at your local IRS office, or by calling 1-800-TAX-FORM (1-800-829-3676), or from the IRS website.

Do have your motor vehicle appraised by a qualified professional appraiser if it is worth more than $5,000.

Do make sure you have the title to your vehicle. A charity should not accept your donation without a title. To obtain a duplicate title, visit your local Registry of Motor Vehicles branch or visit the Registry's website.

Do take responsibility for transferring the title at the time of the donation. An assignment of title should be made only to the charity or an authorized private, for-profit agent of the charity. The for-profit agent of the charity should be subject to the charity’s oversight in order for the agency to be valid for tax-deductibility purposes. The IRS has published "A Charity’s Guide to Vehicle Donations" (Publication 4302), which details the required terms of the agency relationship. You can obtain Publication 4302 from the IRS at your local IRS office, or by calling 1-800-TAX-FORM (1-800-829-3676), or from IRS website links to PDF file.

On the back side of your title, you should assign the title to the charity or an authorized agent of the charity, enter the correct mileage from the odometer, and sign and date the form. Be sure to make and keep a copy of both sides of your title.

Do maintain a personal record of your donation. Items that should be included in your record include:

  • The written contemporaneous acknowledgment from the charity;
  • The name and address of the organization to which you contributed;
  • The date and place where your vehicle was picked up;
  • A reasonably detailed description of the donated car or a photograph of the car;
  • The fair market value of the car at the time of the contribution and how that value was calculated;
  • A signed copy of the appraisal, if the motor vehicle was appraised;
  • Any terms or conditions attached to the car donation;
  • How you obtained the car (by purchase, gift, inheritance, etc.) and the date; and
  • A copy of your title, registration, and any receipts you are given by the tow company or the charity.

How much will my tax write-off be?
The amount that is tax deductible is the sale price of the vehicle. The value of your vehice is determined by the gross proceeds raised from the sale of the donated vehicle. You no longer have the burden of determining the value yourself. Before filing your tax write-offs, please visit the IRS Publication 526 which sets forth the manner in which the IRS requires you to determine the value of your donated property.

Will I get a tax receipt for my donation?
Yes, our driver will issue a receipt at the time of pick-up. This is not your final tax receipt unless the sale of your vehicle does not exceed $500. This initial acknowledgement will indicate your name as well as the year, make, model and condition of the car you are donating. It will be your only receipt if your vehicle sells for less than $500. An IRS Form 1098-C, Contributions of Motor Vehicles, Boats, and Airplanes will be mailed to you within 30 days of the sale stating the amount of gross proceeds received from your car, provided your vehicle sold for more than $500. This will be your tax receipt for your charitable contribution.

What type of paperwork will I need to donate my car?
You will need a clear title on the vehicle. Any lien holder listed on the title must be cleared and or released by the bank. This law varies by state. Please refer to the DMV in your state for clear instructions. If you do not have the title, please call us anyway. It is possible that other arrangements may be made.

Do I need a smog certificate in order to donate my car?
For states that require smog certificates or safety inspections, you may donate your vehicle without these documents.

Charity Cars is the first organization of its kind to implement a free vehicle program nationally. Charity Cars collects vehicle donations and gives them to disadvantaged families for free. The Charity Cars organization was established in 1996 with a mission to engage in activities that uplift humanity. One of the many ways Charity Cars upholds its mission is to provide free vehicles and vehicle support services to disadvantaged families. Charity Cars uses each Massachusetts car donation made to help struggling families in their transition from dependency to self-sufficiency or to help fund the mission. Since being established, Charity Cars has assisted thousands of families throughout the United States.

Nationwide
Massachusetts residents can donate their unwanted vehicles to the Charity Cars program by filling out the online car donation form or calling 1-800-242-7489. Charity Cars has implemented a nationwide donation system which allows them to make arrangements to pick up vehicle donations in any state. WHAT ARE THE BENEFITS OF DONATING MY CAR TO WGBH?

WHAT DOES WGBH DO WITH THE DONATED VEHICLES?
The vehicles are sold at a private auction. The funds from vehicle donations are used by WGBH to support and produce quality educational and entertainment programs as well as to support our outreach efforts in our community.

DOES MY CAR HAVE TO BE RUNNING TO QUALIFY FOR DONATION?
In some cases we can take your car, running or not. However, it must have an engine and be towable.

WHAT PAPERWORK DO I NEED?
The only paperwork needed is a signed, clear title. Have your title with you when you call in your donation. (Please note: a clear title indicates the title is in the name of the donor without a lien.)

WHAT IF I LOST THE TITLE?
You will need to get a duplicate title and call us when you have received it. We cannot pick up your vehicle if you do not have the title. Log onto www.mass.gov/rmv/titles/6dup.htm or call 617-351-4500 for information on how to obtain a duplicate title in Massachusetts, or contact your state registry of motor vehicles department. Unfortunately WGBH cannot help you in this process.

WHAT IF MY CAR WON'T PASS THE STATE INSPECTION?
We can accept vehicles without a state inspection sticker or current registration as long as there is a clear title.

DO I NEED A SMOG CERTIFICATE IN ORDER TO DONATE MY CAR?
For states that require smog certificates or safety inspections, you may donate your vehicle without these documents.

HOW DOES THE NEW LAW AFFECT MY TAX DEDUCTION?
Donors are no longer responsible for determining the deductible value of their donation. Instead, they will receive IRS Form 1098–C, Contributions of Motor Vehicles, Boats, and Airplanes if the proceeds from the sale exceed $500, stating the amount of the gross proceeds from the sale of the donated vehicle. The amount listed on IRS Form 1098-C, Contributions of Motor Vehicles, Boats, and Airplanes will be the gross proceeds of the deductible donation.

WILL I GET A TAX RECEIPT FOR MY DONATION?
Yes, our driver will issue a receipt at the time of pickup. This is not your final tax receipt unless the sale of your vehicle does not exceed $500. This initial acknowledgement will indicate your name as well as the year, make, model, and condition of the car you are donating. It will be your only receipt if your vehicle sells for less than $500.

WHAT CAN I CLAIM AS MY DEDUCTION?
According to the tax law effective Jan. 1, 2005, if the claimed value of the donated vehicle exceeds $500, the taxpayer is limited to the gross proceeds of the sale.
An IRS Form 1098-C, Contributions of Motor Vehicles, Boats, and Airplanes will be mailed to you within 30 days of the sale stating the amount of gross proceeds received from your car, provided your vehicle sold for more than $500. This will be your tax receipt for your charitable contribution.

HOW IS THE VALUE DETERMINED ON THE VEHICLE DONATED?
The value is determined by the gross proceeds raised from the sale of the donated vehicle. You no longer have the burden of determining the value yourself.

DOES THE NEW LAW AFFECT WGBH?
WGBH has additional paperwork in reporting the gross proceeds raised from the sale of the vehicle to the donor and IRS. The process of obtaining the cash donation from the vehicle remains the same.

WHAT IF MY CAR IS VALUED AT MORE THAN $5,000?
Effective January 1, 2005, you are no longer required to have vehicles appraised. The value you may claim will be the amount of gross proceeds received from your vehicle.

WHEN IS THE LATEST TIME I CAN DONATE A VEHICLE TO WGBH AND QUALIFY FOR A TAX DEDUCTION IN THE CURRENT TAX YEAR?
Vehicle donations committed to WGBH by midnight of Dec. 31 are considered as donations for that tax year, even if the vehicle is picked up and sold after Jan. 1.

DO I HAVE TO BE WITH THE VEHICLE AT THE TIME OF PICKUP?
No. Special arrangements can be made by calling our representative.

DO I PAY FOR THE TOWING?
No, there is no charge to you for the towing.

DO I BECOME A WGBH MEMBER BY DONATING MY CAR? IF SO, WHAT LEVEL OF MEMBERSHIP WILL BE OFFERED?
You will become a member at the Individual Membership level after your car is sold at auction and proceeds are credited to WGBH. Your membership will be a one-year membership. If you are a WGBH member at the time your car is sold at auction your membership will be extended for one year. Tax Advantages when Donating Your Car to Massachusetts

Unlike some other car donation programs, Good News Garage does not offer "free gifts" in exchange for car donations. Gifts impact the value of your charitable tax deduction. According to the IRS Publication 526: Charitable Contributions, any benefit received as a result of the donation must offset the tax deduction. Good News Garage does not offer gifts for vehicle donations, because we do not wish to devalue your tax deduction.

STEP 2: Good News Garage inspects your vehicle
Qualified mechanics conduct a 72-point inspection of the vehicle. Depending on a number of factors, including the mileage and cost of repairs needed, Good News Garage determines how to process the vehicle.

STEP 3: Good News Garage processes your vehicle
Scenario 1: Your vehicle is repaired and provided to a low-income family. Lack of transportation is a major barrier to employment and education for the families we serve. When a vehicle is provided to a family in need, the donor may deduct the fair market value (defined as the price the car would have sold for on the open market). To determine your vehicle's value, please refer to the Kelley Blue Book or NADA websites.

Scenario 2: Your vehicle is sold at auction to benefit Good News Garage. Donated luxury cars, cars too expensive to repair, or cars that are not a good match for families are sold at auction. Money from these sales help pay for repairing vehicles for families. On average, GNG spends more than $1,500 on every car provided to ensure it is safe and reliable. When a car, truck or van goes to auction, the donor may deduct what the car sold for or $500, whichever is greater.

STEP 4: Good News Garage sends you a tax deduction letter
Once your car donation has been processed (which can take eight to 12 weeks) you will receive a letter in the mail outlining what happened to your vehicle and how much you can deduct on your taxes. Please note that as required by the IRS, Good News Garage will need to include your social security number in your tax deduction paperwork if your tax deduction is more than $500.You do not need to provide your social security number if you do not want a tax deduction.
