Texas Mesothelioma Lawyers

With its proximity to the U.S. Gulf of Mexico, Texas is home to a large number of oil refineries and shipyards, including the country’s largest refinery, ExxonMobil. Because these operations require constant intense heat, companies for decades used asbestos to line their equipment and pipes as well as required workers to wear asbestos-laden protective clothing. Consequently, thousands of Texas residents have been exposed to asbestos, putting them at risk for developing mesothelioma and other asbestos-related diseases.

At the same time, even more people have been exposed to asbestos simply because of where they live. Residents who live near locations along W.R. Grace vermiculite mine truck route were exposed until 1992, when the company stopped shipping thousands of tons of asbestos to 24 locations throughout the state. Because of this, scores of people in these areas and along the truck travel routes have developed mesothelioma, a cancer that impairs lung function.

When asbestos breaks, it releases microscopic fibers that become lodged in the body. Over time, they build up, mutate and create cancerous cells and tumors. This is a serious issue for Texas residents. Between 1990 and 2008 alone, more than 1,620 Texas residents have died from asbestos-related conditions, giving Texas the fourth-highest asbestos deaths in the United States.

Texas Oil Workers, Shipyard Crews at Highest Risk

While residents living near asbestos mines are at risk for developing mesothelioma, the biggest risks are to those who worked in oil refineries and shipyards. Typically, oil workers, including those at the ExxonMobil refinery, were subjected to poorly ventilated working conditions and were required to work directly with asbestos because the material’s fire- and heat-resistant properties. Asbestos has been used in boilers, pipes and clothing, just to name a few.

In addition, workers in the more than a dozen shipyards and ports that dot the Gulf Coast face serious risks. Those in the Barbours Cut Container Terminal in the Houston area have been exposed to substance, as have many who work in the businesses operating in and around the Port of Houston. Workers at the Galveston wharves and the Port of Galveston have been exposed as well, and many of them have filed suit as a result. In the coming months, even more workers and local resident are expected to step forward with asbestos claims because of the destruction left by Hurricane Ike in 2008. Because of this, Houston residents and workers are among those with the highest risk of developing an asbestos-related condition in the state. Dallas and San Antonio residents have similar risks.

Texas Asbestos Regulations

To prevent more people from being injured, the state government has enacted several regulations, which are part of the Texas Asbestos Health Protection Rules. Approved in 1992 to minimize the possibility of exposure, the laws state that people who remove asbestos must be appropriately licensed or registered, including electricians, plumbers and carpenters. These individuals must also use specific protective clothing while removing asbestos.

Medical Criteria for Mesothelioma

Texas residents who develop mesothelioma may want to sue for damages, but they must meet specific medical criteria to do so. For example, State Bill 15 separates the claims of those who have been rendered impaired by their condition from those who have not, allowing only the injured parties to sue. It does, however, allow unimpaired people who later get sick to sue.

Filing Mesothelioma Lawsuits in Texas

Between 1998 and 2000, Texas led the nation in the number of asbestos lawsuits as a result of the high levels of exposure. To help unclog the legal system, state legislators created narrow restrictions for those wanting to sue. In addition to limiting lawsuits to people who are impaired as a result of their exposure, the state allows claimants only two years to file a suit, called a statute of limitations. The clock starts when a patient gets an official diagnosis. Claimants are also required to consent to becoming part of a multiclaim suit. Non-residents are not allowed to file suit. What is Asbestos?

Asbestos is a heat-resistant silicate material that is fibrous in form. It can be woven into fabrics, and is often used in insulating and fire-resistant materials such as roofing materials, flooring materials, thermal insulation, and acoustic insulation.
There are six different minerals that are defined by the United States Environmental Protection Agency as asbestos, including:
Chrysotile: The most commonly used type of asbestos, chrysotile can be found in roofs, ceilings, walls, and floors of homes, schools, and businesses. Chrysotile asbestos is also used in motor vehicle components such as brake linings, gaskets, and seals.
Tremolite: Tremolite can be found as a contaminant in chrysotile asbestos, vermiculite, and talc powders. It was occasionally used in certain insulation products, paints, sealants and roofing materials. Tremolite can be white, green, gray, or even transparent.
Amosite: Also known as brown asbestos, amphibole originates in Africa. It can be found in cement sheet and pipe insulation, as well as insulating board, ceiling tiles, and thermal insulation products. It has needle-like fibers.
Crocidolite: This blue asbestos is known for its ability to resist heat. It is mined primarily in South Africa, Bolivia, and Australia, and is widely considered the most dangerous type of asbestos. Crocidolite can be found in some spray-on coatings, pipe insulation, and cement products.
Anthophyllite: Gray-brown in color, anthophyllite originates from Finland. It was most commonly found in composite flooring, and is no longer used commercially (though it may still be found as a contaminant).
Actinolite: This mineral has a harsh texture and is not as flexible a other types of asbestos. It is most often found in metamorphic rock. Actinolite was never used commercially, but it can be found as a contaminant in some asbestos products.

Asbestos Causes Health Problems

When the fibers from asbestos become airborne and are inhaled, they can cause serious health issues. This is because of the small size of asbestos fibers, which the lungs cannot expel. These fibers are sharp and can penetrate tissues.
There are many health problems attributed to asbestos, including:
Asbestosis: Asbestosis is scarring of the lung tissue caused by acid produced by the body in an attempt to dissolve asbestos fibers. Sometimes, the scarring can become so severe that the lungs no longer function. This deadly disease can have a latency period of 10-20 years, meaning that someone can contract the disease but not show signs of it for nearly two decades.
Mesothelioma: Mesothelioma is a cancer of the mesothelial lining of the lungs and the chest cavity, abdominal cavity, and the pericardium (a sac surrounding the heart). Unlike lung cancer, mesothelioma is not associated with tobacco use. It is caused by exposure to asbestos or similar fibers. The latency period for mesothelioma can be 20-50 years, and most patients die within a few years of being diagnosed.

Cancer:Asbestos can cause lung cancer, as well as cancer of the gastrointestinal tract, kidney, and larynx. The latency period for cancer is often 15–30 years.
Diffuse pleural thickening: Also known as DPT, diffuse pleural thickening is a lung disease in which extensive scarring thickens the thin membrane that covers the lungs (called the pleura). As the scar tissue grows, it can close off the space between the lungs and the pleura. This condition can cause chest pain and extreme difficulty breathing.

Asbestos was officially labeled a Class A Human Carcinogen in 1980. People can be exposed to asbestos both from working directly with the product itself or by simply being in the presence of disturbed asbestos. Exposure can be from either your home or the workplace. Asbestos fibers can be released into the air, and when inhaled, they can get trapped in the lungs, causing serious health problems, including many forms of cancer.

Mesothelioma: Mesothelioma and lung cancer were the first kinds of cancer to be linked to asbestos exposure. Mesothelioma is a rare and deadly type of cancer that can affect the tissues surrounding your lungs, abdomen, heart and testicles. The latency period for mesothelioma, the time it takes between when one is exposed to asbestos and when the disease develops, is 20 to 50 years.
Lung Cancer: The relationship between asbestos exposure and lung cancer was first made in 1935 and was later confirmed in 1942. According to The Mesothelioma Center, asbestos lung cancer is the most common cause of cancer death in the US. There are an estimated 4,800 deaths related to asbestos lung cancer each year. Like Mesothelioma, asbestos related lung cancer also has a long latency period. On average, it takes 15 to 35 years for lung cancer to develop after exposure to asbestos.
Other Cancers: In addition to Mesothelioma and lung cancer, asbestos exposure has also been linked to other cancers including ovarian, laryngeal, gastrointestinal and colorectal.
Asbestosis: Asbestosis is a breathing disorder with scarring of lung tissue caused by inhaling asbestos fibers. Symptoms include shortness of breath, chest pain, coughing, and sometimes deformity of the fingers. Asbestosis also increases your risks of developing lung cancer.

Who is at risk?

Anyone who has been exposed to asbestos, either by working directly with the product or by being in an environment where asbestos has been disturbed, can be at risk. In particular, people who worked in mining, manufacturing, railroads, shipyards, or who installed or removed asbestos before the late 1970’s are at risk.

Asbestos is a heat-resistant silicate material that is fibrous in form. It can be woven into fabrics, and is often used in insulating and fire-resistant materials such as roofing materials, flooring materials, thermal insulation, and acoustic insulation.
There are six different minerals that are defined by the United States Environmental Protection Agency as asbestos, including:

• Chrysotile: The most commonly used type of asbestos, chrysotile can be found in roofs, ceilings, walls, and floors of homes, schools, and businesses. Chrysotile asbestos is also used in motor vehicle components such as brake linings, gaskets, and seals.
• Tremolite: Tremolite can be found as a contaminant in chrysotile asbestos, vermiculite, and talc powders. It was occasionally used in certain insulation products, paints, sealants and roofing materials. Tremolite can be white, green, gray, or even transparent.
• Amosite: Also known as brown asbestos, amphibole originates in Africa. It can be found in cement sheet and pipe insulation, as well as insulating board, ceiling tiles, and thermal insulation products. It has needle-like fibers.
• Crocidolite: This blue asbestos is known for its ability to resist heat. It is mined primarily in South Africa, Bolivia, and Australia, and is widely considered the most dangerous type of asbestos. Crocidolite can be found in some spray-on coatings, pipe insulation, and cement products.
• Anthophyllite: Gray-brown in color, anthophyllite originates from Finland. It was most commonly found in composite flooring, and is no longer used commercially (though it may still be found as a contaminant).
• Actinolite: This mineral has a harsh texture and is not as flexible a other types of asbestos. It is most often found in metamorphic rock. Actinolite was never used commercially, but it can be found as a contaminant in some asbestos products.

Asbestos Causes Health Problems

When the fibers from asbestos become airborne and are inhaled, they can cause serious health issues. This is because of the small size of asbestos fibers, which the lungs cannot expel. These fibers are sharp and can penetrate tissues.
There are many health problems attributed to asbestos, including:

• Asbestosis: Asbestosis is scarring of the lung tissue caused by acid produced by the body in an attempt to dissolve asbestos fibers. Sometimes, the scarring can become so severe that the lungs no longer function. This deadly disease can have a latency period of 10-20 years, meaning that someone can contract the disease but not show signs of it for nearly two decades.
• Mesothelioma: Mesothelioma is a cancer of the mesothelial lining of the lungs and the chest cavity, abdominal cavity, and the pericardium (a sac surrounding the heart). Unlike lung cancer, mesothelioma is not associated with tobacco use. It is caused by exposure to asbestos or similar fibers. The latency period for mesothelioma can be 20-50 years, and most patients die within a few years of being diagnosed.
• Cancer:Asbestos can cause lung cancer, as well as cancer of the gastrointestinal tract, kidney, and larynx. The latency period for cancer is often 15–30 years.
• Diffuse pleural thickening: Also known as DPT, diffuse pleural thickening is a lung disease in which extensive scarring thickens the thin membrane that covers the lungs (called the pleura). As the scar tissue grows, it can close off the space between the lungs and the pleura. This condition can cause chest pain and extreme difficulty breathing.

WHAT IS ASBESTOS?

People are exposed to asbestos mainly by inhaling fibers in the air they breathe. It may also occur when older buildings are demolished or renovated, or when older asbestos-containing materials begin to break down. People most at risk for developing mesothelioma or other asbestos-related illnesses include workers whose jobs directly expose them to asbestos fibers.

The people with the heaviest exposure are those who worked in asbestos industries, such as shipbuilding and insulation. Many of these people recall working in thick clouds of asbestos dust, day after day. Family and friends of these workers are also at risk due to "household exposure." WHY IS ASBESTOS HARMFUL?

Asbestos fibers produce dust. When inhaled, asbestos dust forms deposits in the lungs that can cause illnesses include mesothelioma, lung cancer and asbestosis. DISEASES RELATED TO ASBESTOS EXPOSURE

MALIGNANT MESOTHELIOMA

Malignant mesothelioma is an extremely aggressive cancer. Asbestos exposure is the only known cause of this terminal illness. The three types of malignant mesothelioma are: Epithelioid, Sarcomatoid and Mixed type.

LUNG CANCER

Asbestos exposure is known to cause lung cancer. The combination of asbestos exposure and cigarette smoking is especially deadly. Scientific studies published by the U.S. Surgeon General indicate that people who smoke and were exposed to asbestos on the job are 90 times as likely to develop lung cancer as people who smoke but were never exposed to asbestos.

ASBESTOSIS

Asbestosis is a lung disease caused by inhaling asbestos dust. The disease produces inflammation and scarring (fibrosis) of the lung.

MEDICAL STUDIES AND RESEARCH LUNG CANCER

Inhalation of asbestos fibers has been linked to an increased risk of lung cancer in many studies of asbestos-exposed workers. In general, the greater the exposure to asbestos, the higher the risk of lung cancer. Most cases of lung cancer in asbestos workers occur at least 15 years after initial exposure to asbestos. In workers exposed to asbestos who also smoke, the lung cancer risk is much greater than even adding the risks from these exposures separately.

MESOTHELIOMA

Mesothelioma is a rare form of cancer that affects the thin membranes lining organs in the chest (pleura) and abdomen (peritoneum). Mesothelioma is closely linked with asbestos; most cases of mesothelioma result from direct exposure to asbestos at work.

Studies have found an increased risk of mesothelioma among workers who are exposed to asbestos, as well as among their family members and people living in the neighborhoods surrounding asbestos factories and mines.

Mesotheliomas typically take a long time to develop. The time between first exposure to asbestos and diagnosis of mesothelioma is usually 30 years or more. Unfortunately, the risk of mesothelioma does not drop with time after exposure to asbestos. The risk appears to be lifelong. Unlike lung cancer, mesothelioma risk is not increased among smokers.

ASBESTOS AND OTHER HEALTH PROBLEMS

The major health problem caused by asbestos exposure, is a lung disease called asbestosis. When a person breathes high levels of asbestos over time, some of the fibers lodge deep in the lungs. Irritation caused by the fibers eventually leads to scarring (fibrosis) in the lungs. This can make it hard to breathe. The main symptoms of asbestosis are shortness of breath and a chronic cough.

When asbestosis occurs, it is typically 10 to 20 years after the initial exposure to asbestos. The disease can get worse over time. While some people may not have serious symptoms, others may be seriously disabled by breathing problems. Unfortunately there is no effective treatment for this disease.

Asbestos can also reach the outer lining of the lungs (pleura), where it can cause pleural plaques (areas of hard, scar-like tissue in the pleura), pleural thickening, and pleural effusions (buildup of fluid between the lungs and the pleura). All of these conditions can make it harder to breathe.
